Navigating our way towards a developed and updated maritime policy and regulatory regime that will position South Africa into becoming a world class maritime economy

SAMSA must ensure that it develops and implements legislation and regulations that ensures that it meets its domestic and international obligations

The Centre for Policy and Regulatory Affairs has been established to drive the policy and compliance agenda.

• To develop policy and regulatory framework
• Provide assistance to the Department of Transport (DoT) in the drafting and formulation of policies, including maritime related legislation.
• Investigate changes in the policy, regulatory and legislative landscape relating to maritime including any other policies and legislation that impacts on SAMSA on an ongoing basis and drive compliance thereof.
• Steward alignment and ratification of International Conventions and codify them into domestic legislation including leveraging global platform on best practice.
• Advise and provide regular updates to the organization of changes in the regulatory and legislative environment and recommend implementation plans and conduct training if necessary.
• Steward and provide coordination of formulation of internal policies.
• To build collaborative partnerships and platforms to engage with key stakeholders (e.g. DoT, industry bodies - to review and discuss developments on jurisprudence, locally and internationally; to discuss its impact and relevance to South Africa’s maritime industry; and to recommend implementation plans.
• To develop Risk Management Framework
• Provide strategic, proactive and timeous legal support in connection with specific SAMSA projects, programmes or initiatives including structuring and negotiating transactions or agreements to support ongoing business activities.
• Provide legal contract management support to other functions within SAMSA, including developing contract management routines and processes. Contract management shall include but not limited to drafting terms and conditions of contract, negotiating, reviewing and drafting agreements.
• Steward culture of legal compliance and minimizing legal risk/exposure to SAMSA and recommend corrective action/mitigation plan.
• Advising and keeping SAMSA updated with legal developments, legislation which impacts or affecting the organization including identifying risks and opportunities.
• Managing outsourced matters including managing panel of attorneys.
